GENERAL TERMS OF USE AND SALE – ID WATCH SA

PREAMBLE

This document consolidates the website terms of use and the general terms of sale for products offered by ID Watch SA (hereinafter referred to as "ID").

ID is a company incorporated under Swiss law, registered under number CHE-330.542.709, with its registered office located at Place Simon-Goulart 2, 1201 Geneva, Switzerland.

The website hosting is provided by Infomaniak (Switzerland). Associated social media platforms (Facebook, Instagram, LinkedIn, etc.) are governed by their respective platforms' terms and conditions.

 

PART I: WEBSITE TERMS OF USE

 

1. ACCEPTANCE OF TERMS

Access to and browsing of the website (hereinafter the "Site") implies the user's unconditional acceptance of these terms. If the user does not accept these terms, they must refrain from using the Site.

 

2. INTELLECTUAL PROPERTY AND CONTENT

2.1. The content of the Site (structure, texts, images, logos, videos, codes) is the exclusive property of ID or its partners and is protected by intellectual property laws.

2.2. The user is authorized to view the Site and download/print copies for strictly personal and non-commercial use.

2.3. Any reproduction, representation, modification, or commercial use of the content without prior written authorization from ID is strictly prohibited.

2.4. ID strives to present product images that are faithful to reality. However, minor variations (colors, screen rendering) may occur. In case of doubt, it is recommended to contact ID before making a purchase.

 

3. USER COMMUNICATIONS

Any unsolicited communication sent to ID via the Site or social media (comments, suggestions, ideas) shall be considered non-confidential. The user grants ID a free, non-exclusive, irrevocable right to use such communications on any medium.

 

4. LIMITATION OF LIABILITY (SITE)

4.1. ID strives to keep the Site up-to-date and error-free but does not guarantee the absolute accuracy, completeness, or permanent availability of the information.

4.2. ID declines any liability in the event of technical malfunction, service interruption, presence of viruses, or damages resulting from third-party intrusions.

4.3. ID shall not be held liable for direct or indirect damages arising from the use of the Site or hypertext links to third-party websites.

 

5. MODIFICATION OF TERMS OF USE

ID reserves the right to modify these terms of use at any time. The online version shall prevail. Continued navigation after modification constitutes acceptance of the new terms.

 

PART II: GENERAL TERMS OF SALE (PRODUCTS)

 

6. SCOPE OF APPLICATION

6.1. These terms govern any sale of ID watches and accessories (hereinafter the "Products") concluded via the Site or any other channel.

6.2. They prevail over any other general terms and conditions of purchase from the customer (hereinafter the "Customer").

 

7. ORDER AND CONTRACT FORMATION

7.1. Procedure: The Customer selects their Products, validates their cart, fills out the order form, and proceeds to secure payment.

7.2. Offer and Validation: The order constitutes an offer to purchase. The contract is definitively formed only after:

   - Validation of Product availability by ID.

   - Receipt of full payment (or the required deposit).

   - Sending of an order confirmation email by ID.

7.3. Right of Refusal: ID reserves the right to refuse any order for legitimate reasons, including obvious pricing errors, incomplete addresses, prior payment disputes, geographic restrictions by the carrier, or non-compliance with these terms.

7.4. Stock Outages: ID shall not be held liable in the event of unforeseen unavailability of a Product. The Customer will be immediately informed and refunded if necessary.

 

8. PRICE AND PAYMENT

8.1. Prices are indicated in Swiss Francs (CHF), excluding taxes (VAT).

8.2. For sales outside Switzerland, the Customer is solely responsible for customs duties, import taxes, and local fees applicable in their country of destination.

8.3. ID reserves the right to modify its prices at any time without notice. Orders are invoiced at the price in force at the time of final validation.

8.4. Payment must be made in full before shipment, unless a written agreement states otherwise for professionals.

 

9. DELIVERY

9.1. Timeframes: Delivery times are indicative and vary depending on the destination. They start running from the order confirmation and payment.

9.2. Transport: ID works with recognized carriers to ensure rapid delivery. Package tracking is provided when available.

9.3. In-store Pickup: Direct pickup is possible by appointment at ID's headquarters in Geneva.

9.4. Receipt and Verification: It is the Customer's responsibility to check the condition of the packaging and Products upon delivery. In case of apparent damage, the Customer must make precise reservations with the carrier and refuse the delivery if necessary, then inform ID within 48 hours. After this period, the Products are deemed compliant.

 

10. RIGHT OF WITHDRAWAL (RETURNS)

10.1. Period: The Customer has a period of 7 (seven) calendar days from receipt to exercise their right of withdrawal (postmark serves as proof).

10.2. Conditions: Returned Products must be new, intact, complete, and in their original, unaltered packaging.

10.3. Refund: ID will proceed with the refund of amounts paid within a maximum of 30 days following the receipt and verification of the returned product. Return shipping costs are borne by the Customer, except in the case of a defective product.

10.4. Exclusions: No refund will be issued for Products that are damaged, incomplete, or show signs of use attributable to the Customer.

 

11. CONFORMITY AND FUNCTIONALITY WARRANTY

ID is committed to the quality and durability of its watches.

 

11.1. Duration and Scope

All ID watches benefit from a contractual warranty of 3 (three) years from the date of purchase.

This warranty covers:

- Material and manufacturing defects of constituent parts (case, dial, hands, crystal, movement).

- Problems resulting directly from an assembly defect carried out by ID.

In the event of a proven defect, ID will, at its choice, repair or replace the Product.

 

11.2. Warranty Exclusions

The warranty does not cover normal wear and tear or accidental damage. The following are explicitly excluded:

- Wear parts: straps (vegetable textile, rubber, metal), buckles, and superficial coatings (scratches, oxidation).

- Components of the automatic module subject to friction: mainspring, rotors, pivots, and gears whose wear is inherent to mechanical operation.

- Water-resistance gaskets (maintenance parts).

- Damage due to shocks, drops, non-compliant immersion, misuse, intervention by an unauthorized third party, or failure to follow maintenance instructions.

 

11.3. Implementation

For any request, the Customer must contact ID's after-sales service (info@idwatch.ch) with proof of purchase. Shipping costs to the service center are borne by the Customer; return shipping costs for the repaired product are borne by ID.

 

12. ECOLOGICAL MYCELIUM PACKAGING

ID uses innovative packaging made from mycelium (mushroom root), which is biodegradable and compostable.

 

12.1. Compostability

The packaging is home-compostable. Simply fragment it and integrate it into a domestic compost bin.

 

12.2. Storage Instructions

If the Customer chooses to keep the packaging, they must strictly adhere to the following conditions to avoid natural degradation:

- Temperature: Store strictly below 30°C.

- Humidity: Maintain a relative humidity (RH) level below 50%.

- Protection: Keep away from direct moisture, heat sources, and pests (insects, rodents).

Failure to comply with these conditions exempts ID from any liability regarding the deterioration of the stored packaging.

 

13. LIABILITY AND LIMITATIONS

13.1. ID's liability is limited to the value of the Product sold. ID shall not be held liable for indirect damages (loss of data, loss of profit, commercial prejudice).

13.2. ID declines any liability in the event of non-compliant use of the Products or failure to follow maintenance instructions.

 

14. GOVERNING LAW AND JURISDICTION

14.1. These terms are governed by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

14.2. Any dispute shall be submitted, as a priority, to an attempt at amicable resolution. Failing an agreement within 30 days, the dispute shall be brought before the competent courts of the Canton of Geneva (Switzerland).

14.3. If the local consumer legislation imposes higher protections than Swiss law, those shall apply by way of derogation.
